Court Rules Polish Law Supreme To EU Law, Sets Up Brussels Battle

Henry Foy at the FT tweets: "Polish court rules that EU law is not compatible with the country's constitution and asserts primacy of Polish law, and says EU cannot intervene in Polish judicial system. This is a major escalation of the rule of law crisis between Warsaw and Brussels. Long-awaited ruling has long been seen as a rubicon moment in Polish-EU relations. Brussels has major financial weapons at its disposal and now will be under extreme pressure from other member states to use them against Warsaw."

  • Jackub Jaraczewski at Democracy Reporting tweets on the case itself: "...the Polish Constitutional Tribunal finds art. 1 TEU and art. 19 TEU incompatible with the Polish Constitution with regards to Polish courts giving primacy to EU law and being able to disregard Polish Constitution and laws. The Tribunal also finds art. 19 TEU incompatible with the Polish Constitution with regards to allowing Polish judges to examine the independence of their peers. Poland just took a legal step towards the abyss of "legal Polexit". "
