COMMUNICATIONS: Vodafone-Three Remedies Proposed; Incremental Positive
COMMUNICATIONS
Vodafone and Three have proposed remedies to the CMA; they look to be broadly in line with the behavioural remedy options outlined by the CMA i.e. time-limited retail customer protections and wholesale access terms. The main risk was in the deal was the need for a structural remedy such as the entry of a new wholesale entrant though this seemed to have been largely ruled out at the CMA’s last update (and was an indicated red line for the involved parties anyway) so this seems more of an incremental positive than anything unexpected.
- Vodafone will maintain tariffs at GBP 10 or below for two years for value-focused customers on SMARTY and VOXI 4 Now brands.
- A reference offer will be provided to MVNOs to access additional network capacity to support competition in the wholesale market.
- On the GBP 11bn network investment, they note they are happy for the programme to be monitored by Ofcom.
- This is all in addition to the VM02 spectrum sale agreement.
- Final decision on the merger from the CMA is expected by 07 Dec.
