Constitutional Tribunal To Rule On What Constitutes Its Full Bench On Jul 13

The Constitutional Tribunal will hear a case on the minimum number of judges forming its full bench at 11:00CEST on July 13, according to the updated docket on its website. The Tribunal will de facto rule in its own case, after the parliamentary majority for unknown reasons froze legislative works that would effectively achieve the same aim.

  • The Tribunal has been unable to hear cases requiring the presence of the full bench, which is defined as at least 11 judges. This is because several judges are boycotting the Tribunal's meetings on the back of their claim that Chief Justice Julia Przylebska's term has expired.
  • At the request of the Prime Minister, the Tribunal will examine the constitutionality of a legal clause which specifies the minimum number of judges in cases that need to be heard by the full bench. The Prime Minister's Office argues that the clause is dysfunctional and prevents the Tribunal from pursuing its constitutional mandate.
