ISRAEL: ICC Issues Arrest Warrants For Netanyahu & Gallant

The International Criminal Court (ICC) has issued arrest warrants for PM Benjamin Netanyahu and former Defence Minister Yoav Gallant. In a statement, the ICC said that the warrants were issued "for crimes against humanity and war crimes committed from at least 8 October 2023 until at least 20 May 2024". The move represents a significant escalation in the legal actions against Israel over the war in Gaza, with the 124 signatories of the Rome Statute who sit as members of the ICC now obliged to arrest either man should they travel to their territory. However, given the ICC has no way to enforce the warrants, the actual impact is likely to prove limited. 

  • Israel is not a member of the ICC, and the gov't has called out the ICC's chief prosecutor in the case against Israel Karim Khan, alleging antisemitism. Khan is also facing an internal inquiry into his conduct following accusations of harassment made by a female colleague, accusations which Khan allegedly then attempted to suppress.
  • Ahead of the decision, incoming US Senate majority leader John Thune (R-SD) said that he would push for sanctions against the ICC if it sought to issue the warrants. As Fox News reports, while the US does not recognise the authority of the ICC, sanctions against the organisation as a whole could have a notable impact. Human Rights Watch noted in 2020 that US sanctions could see service providers ranging from banks to vending machine companies cut off the ICC for fear of being hit by secondary sanctions.
