EMISSIONS: Norwegian Air Wins ETS Court Ruling, €33mn Penalty Deemed Unlawful

Oslo District Court has ruled in favour of Norwegian Air Shuttle, declaring the airline's method of fulfilling its 2020 EU ETS obligations lawful and overturning a NOK400mn (€33.7mn) penalty, according to the airline.
- The company is entitled to a full refund of the penalty, including interest currently amounting to NOK82.6mn, if the decision becomes final and enforceable.
- The firm was notified about the penalty in 2021, but because the firm was under reconstruction it was not allowed to fulfil its EU ETS obligations, according to Norwegian.
- Norwegian Air Shuttle noted the judgment is not final as Norway's Ministry of Climate and Environment may appeal the ruling.
