GERMANY: So reading through the two case files. The May 5 ruling that stated we
all knew before about needing proportionality etc and regarding the German
Federal Govt and Bundestags to conduct a proportionality assessment. That is a
separate case to the one making headlines today for being dismissed.
- It seems this separate case in the headlines today is dismissed because: "It
is only partially directed against suitable complaint objects (I.) and,
moreover, does not meet the requirements for a sufficiently substantiated
reasoning (II.)"
- It explicitly states that this is different to the May 5 ruling.
- So overall this still leaves the question marks from the May 5 ruling.
