ENERGY: Biden Could Permanently Ban Oil Drilling in Some Fedl Waters

Outgoing US President Joe Biden is expected to invoke an obscure provision of the 1953 Outer Continental Shelf Lands Act that would give him latitude to withdraw federal waters from future oil and gas leasing, the NYT reported.

  • Biden could implement the ban as soon as Jan. 6, affecting large sections of the Atlantic and Pacific oceans as well as other federal waters . This would be difficult for the Trump administration to undo.
  • Section 12(a) of the Act gives a president wide leeway to ban drilling, however, it does not include language to allow any future president to revoke the ban.
  • In 2019 Trump tried to revoke a similar ban implemented by Obama covering the parts of the Arctic and Atlantic Oceans but was a US District Court ruled that it would require Congressional approval.
