Prime Minister Asks Constitutional Tribunal To Rule In Its Own Case

Prime Minister Mateusz Morawiecki told reporters that his office will file a request with the Constitutional Tribunal to rule over what constitutes a full bench of its judges after a boycott announced by several of them has prevented the top court from reaching the quorum needed to hear important cases.

  • The Prime Minister will ask the Tribunal to review the constitutionality of a bill regulating its internal procedures, which stipulates that the full bench consists of at least 11 out of 15 judges. The threshold was raised by Morawiecki's Law and Justice party from 9 previously.
  • A group of Law and Justice lawmakers recently tabled a draft bill lowering the quorum but parliament has so far failed to pass the legislation. A senior lawmaker told PAP newswire that works on the bill will be suspended until the Tribunal considers the Prime Minister's request.
  • Morawiecki reminded that the Tribunal's decision would be final and could not be changed or appealed and argued that the full bench could consist of a smaller number of judges.
