EU Court To Rule On Polish Judicial Reforms Battle On June 05

POLAND
  • EU TOP COURT TO RULE JUNE 5 ON POLISH JUDICIAL REFORMS FIGHT (BBG)
  • From an article recently published by Bloomberg:
  • Poland’s ruling party introduced legislation to defuse a standoff in the nation’s constitutional court and pave the way to access billions in European Union funding.
  • The new rules would affect Poland’s Constitutional Tribunal, which is reviewing a proposed overhaul of the nation’s judiciary crucial to unlocking more than €35 billion ($38.6 billion) in post-pandemic funding. While parliament approved the reforms in February, President Andrzej Duda threw the package into limbo by submitting it for review rather than signing it.
  • The judiciary changes are at the centre of Warsaw’s ongoing conflict with the European Commission. The overhaul, which would roll back a controversial mechanism for disciplining judges, is a condition for receiving EU funds.
  • The latest legislation put forward by the right-wing Law & Justice party would reduce the minimum number of judges required to make a decision on the 15-member tribunal to nine from 11 — potentially short-circuiting a dispute among the court’s justices that’s threatened to block the review.
