Top Court Rules Against Gov't On Media Overhaul

Poland’s Constitutional Tribunal (TK) has ruled against the gov't of PM Donald Tusk as it seeks to overhaul the country's state media setup. English-language outlet Notes From Poland reports the TK ruling that the gov't, "using commercial law to implement changes in the management of public media or to liquidate them – the methods used last month by the government – is unconstitutional."

  • The FT reports, "Tusk’s culture ministry said Thursday’s ruling on state media had “no legal significance” because of the court’s politicisation. “Judgments issued with the participation of so-called double judges do not have universally binding force and are not final,” it said, noting that the European Court of Human Rights in 2021 found that Poland’s constitutional tribunal was no longer an independent court."
  • As noted in an earlier bullet from MNI (see 0806GMT bullet), tensions between the new pro-EU gov't of PM Donald Tusk, and the institutions held by elected officials/appointees from the right-wing populist Law and Justice Party (PiS) such as the presidency and judiciary, are unlikely to subside and could continue to impact policy enactment.
