SCOTUS Oral Arguments On 14th Amendment Challenge To Trump Today

10:00 ET 15:00 GMT: The US Supreme Court will hear arguments today on Colorado’s decision to remove former President Donald Trump from the presidential ballot based on an interpretation of the 14th amendment barring candidates who have engaged in “insurrection.” LIVESTREAM

  • Today's action will mark the first time the SCOTUS has appeared in public to discuss the events of January 6, 2021, and Trump's criminal trials, more broadly.
  • Conventional wisdom states that the conservative majority panel will throw the case out. Either based on their conservative alignment or due concerns that the court could become too deeply embroiled in the election process or fears that removing Trump from the ballot could provoke political instability.
  • CNN notes that the Colorado case, and the other pending ruling on Trump’s immunity in his federal electoral interference case, “could thrust the justices deeper into a presidential election than at any time since the court decided the disputed 2000 election.”
  • The Washington Post notes: “The court could rule more narrowly, finding, for example, that Colorado was wrong to bar Trump because of a technicality. But election law experts have implored the justices to definitively decide the key question of whether Trump is disqualified under Section 3 of the 14th Amendment, settling the issue nationwide so that other states with similar challenges to Trump’s candidacy follow along.”
