CJEU Forces Poland To Pay EUR1mn/Day Over Judicial Reforms Ruling

The Court of Justice of the European Union (CJEU or Curia) has issued a ruling that fines the Polish gov't EUR1mn per day that it does not adhere to a previous ruling relating to judicial reforms enacted previously by the gov't in Warsaw.

  • The court imposes the fine for as long as the disciplinary chamber of the Polish Supreme Court remains operational, in contravention of a previous EU ruling.
  • This fine will sit on top of an existing EUR500k/day fine imposed for the continued operation of the Turrow coal mine in breach of an EU ruling.
  • The European Commission has threated to restrict structural funding to Warsaw due to alleged breaches of the EU's rule of law standards. It is unclear whether these fines could be withdrawn from structural funding to Poland should the gov't refuse to pay.
