UK: Following on from 08:59 bullet, the re-writing of the Withdrawal Agreement
Bill (WAB) seeking to 'legally prohibit' an extension to the transition period
would be in direct contradiction of the Withdrawal Agreement signed with the EU,
which facilitates such an extension.
- With international treaties taking precedence in the legal order, the effect
of prohibiting an extension in the WAB may be null-and-void, and would certainly
be challenged in the courts by anti-no dealers.
- This could set up what Johnson would term a 'people's government' vs. 'the
establishment' clash in the courts in 2020.
- A notable passage of the Conservative election manifesto read: "After Brexit
we also need to look at the broader aspects of our constitution: the
relationship between the government, parliament and the courts".
- Given this statement, Johnson's large majority, and his advisor Dominic
Cummings' preference for major reform (indeed revolution) to UK political
institutions, in 2020 the debate over a potential extension to transition period
could spill over into wider constitutional rancour.
